These Terms of Use are the rules for using marketingwizusa.com and everything we offer through it: our forms, our emails and text messages, our free resources, and the calls you book with us (together, our "Services"). By using our Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use our Services.

The short version

• Our free resources are for you and your business. Please do not resell or republish them.
• Our marketing services run under a separate signed agreement, and any guarantee lives in that agreement.
• The results we share are real, but every business is different, so they are not a promise of your results.
• Texts are optional, and you can reply STOP at any time.

1. Who we are

Marketing Wiz is the business name of Global Online Enterprises, LLC, a West Virginia limited liability company at 5800 Corporate Drive, Suite 326, 3rd Floor, Pittsburgh, PA 15237. You can reach us at info@marketingwizusa.com or +1 (347) 255-3061. "We," "us" and "our" mean Marketing Wiz. "You" means the person using our Services, and the business you represent, if any.

2. Who can use our Services

You must be at least 18 years old to use our Services. If you use them for a business, you confirm that you have the authority to accept these Terms for that business.

3. Our free resources

Our guides, templates, videos, audits and other free resources are for your own use and for your own business. You may print them and share them with your team. You may not sell, republish or repost them, present them as your own, or use them to build a competing product.

Our content shares what has worked for us and for our clients. It is general business education. It is not legal, tax, accounting or financial advice. Talk to a qualified professional about your specific situation.

4. Paid products

If we sell a product through our website, such as a book, course or template, the price, what is included, and the refund terms are shown on the product or checkout page. Prices are in U.S. dollars. If a product is a subscription, it renews automatically until you cancel, and the checkout page will show the renewal terms before you buy.

5. Calls and marketing services

Strategy calls. Calls you book with us are free and come with no obligation to buy anything. We may record and transcribe calls, as explained in our Privacy Policy.

Services under a signed agreement. Our marketing and consulting services are provided under a separate written agreement. If that agreement conflicts with these Terms, the agreement controls.

Guarantees. Any guarantee we offer for our services, including any results-or-your-money-back promise, applies only as written in your signed agreement and under the conditions stated there.

6. Results

The results, numbers and case studies we share are real. They come from specific businesses, each with its own market, offer, team, budget and effort. They are not typical or guaranteed, and they are not a promise of what your business will achieve. Your results depend on many things we do not control.

7. Text messages (SMS terms)

What you get. Our forms have two text message consent boxes. If you check the first, you agree to receive service messages from Marketing Wiz at the number you provided: replies about your inquiry, confirmations and reminders for calls you book, and updates about your account or our work together. If you check the second, you agree to receive marketing messages from Marketing Wiz: offers, promotions, new resources, events and updates. Messages may be sent using automated technology.

Not required. Both boxes are optional. You can submit our forms without checking either one, and consent to receive texts is not a condition of any purchase.

How often. Message frequency varies.

Cost. Message and data rates may apply, based on your mobile plan.

How to stop. Reply STOP to any message. We will send one text to confirm, and then no more texts unless you sign up again. You can also email info@marketingwizusa.com.

How to get help. Reply HELP to any message, email info@marketingwizusa.com, or call +1 (347) 255-3061.

Carriers. Mobile carriers are not liable for delayed or undelivered messages.

Your number. Only give us a phone number that you own or are allowed to use. If you change or give up your number, reply STOP first or let us know.

Privacy. Our Privacy Policy explains how we handle your information. We never share your mobile number or your text message consent with anyone for their own marketing.

8. Emails

When you give us your email address through our forms, we will email you about your request. If you join our list, we will also send newsletters, resources and offers. You can unsubscribe at any time using the link in any marketing email.

9. Testimonials, feedback and your content

If you send us a review, testimonial, photo, idea or other content, you confirm that you have the right to share it. You allow us to use your feedback and ideas to improve our Services without paying you. We will ask your permission before we publish your name, your business's name or your photo in a testimonial or case study.

10. Our content

Everything in our Services, including our text, videos, frameworks, tools, logos and the Marketing Wiz name, belongs to Marketing Wiz or our licensors and is protected by copyright and trademark law. Except as these Terms allow, you may not copy, reproduce, distribute, sell, scrape or create works based on it, or use it to train artificial intelligence models.

11. Acceptable use

When you use our Services, please do not:

• break the law or violate anyone's rights;
• give false information or pretend to be someone else;
• submit another person's phone number or email address without their permission;
• send spam or harmful code through our forms;
• try to hack, overload, scrape or interfere with our website or systems;
• use our Services to build a competing product.

12. Other websites and tools

Our Services link to and use other companies' websites and tools, such as scheduling, video calls, payments and social media. We are not responsible for them, and their own terms apply.

13. Disclaimers

Our Services are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that our Services will be uninterrupted or error-free, or that they will meet every need.

14. Limitation of liability

To the fullest extent the law allows:

• we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data; and
• our total liability for any claim relating to our Services is limited to the greater of (a) the amount you paid us for the product at issue in the 12 months before the claim, or (b) $100.

Some places do not allow these limits, so they may not apply to you. Services provided under a signed agreement are governed by the limits in that agreement.

15. Indemnity

If you misuse our Services or break these Terms, and that leads to a claim against us, you agree to cover our reasonable losses and costs from that claim, including attorneys' fees.

16. Suspending access

We may suspend or end your access to our Services if you break these Terms. The parts of these Terms that should naturally continue after that, such as content ownership, disclaimers, limits of liability and disputes, still apply.

17. Disputes and governing law

If you have a problem with us, please email info@marketingwizusa.com first. Most issues get solved quickly, and we ask that you give us 30 days to try before taking legal action.

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws rules. Any legal action must be brought in the state or federal courts located in Allegheny County, Pennsylvania, and you and we agree to those courts.

18. Changes to these Terms

We may update these Terms. When we do, we will change the "Last updated" date at the top. If you keep using our Services after an update, the new Terms apply. Changes do not apply to a purchase you made before the change.

19. General

These Terms, our Privacy Policy and any terms shown at checkout are the full agreement between you and us about our Services, except where you have a signed agreement with us. If any part of these Terms cannot be enforced, the rest still applies. If we do not enforce part of these Terms right away, we can still enforce it later. You may not transfer your rights under these Terms. We may transfer ours to a company that takes over our business.
